Reminder: Broadband Data Collection (“BDC”) report due September 3, 2024 | Kelley Drye & Warren LLP

The successor to the Form 477 Local Competition and Broadband Report, the BDC report collects broadband availability and other data on a semi-annual basis. The next report is due on September 3, 2024 and will cover data as of June 30, 2024. Special, asset-based Broadband service providers submit data to the BDC system indicating where they made broadband Internet access services available to the mass market as of June 30, 2024. Along with fixed-line and wireless service providers, they must also submit their subscription data to the BDC system as of June 30, 2024 (as required by Form 477). The BDC filing is due on 3 September 2024(because the usual deadline, September 1st of each year, falls on a Sunday this year and September 2nd, 2024 is a holiday).

The FCC provided details of the upcoming BDC reporting deadline in a June 25, 2024 public notice (later corrected to a June 27, 2024 filing deadline). Detailed training materials, including instructions for accessing the Broadband Serviceable Location Fabric in connection with submitting fixed broadband availability data, are available at Broadband Data Collection Resources.

The following BDC submitters are mandatory:

(1) Facilities-based providers of fixed and/or mobile broadband Internet access (ie., faster than 200 kbps, in at least one direction) with end-user connections in service on 30 June 2024;

(2) providers of fixed voice services, including incumbent local exchange operators and competing local exchange operators (whether providing wired or fixed wireless local exchange services), whose end-user connections are in service on 30 June 2024;

(3) providers of networked VoIP services whose end-user connections are in operation on 30 June 2024; and

(4) equipment-based providers of mobile voice services with end-user connections in operation on 30 June 2024.
