APC reports Enugu judge to NJC for injunction to expel members – The Whistler Newspaper

The All Progressives Congress (APC), South East Zone, has reported Honourable Justice CVC Ezeugwu of the Enugu State High Court to the National Judicial Council (NJC) for issuing an injunction restraining the Enugu State Chairman, Barr. Ugochukwu Agballah, and ten others from impersonating party officials.

The interim injunction was granted after other members of the APC filed a similar application.

However, the party leadership in the southeast expressed its displeasure with this order and announced that it would challenge it.

In a statement signed by Dr. Ijeomah Arodiogbu, National Vice President of APC South East Zone, and made available to journalists on Sunday, the party criticised the order issued on August 7, 2024 in Suit No. E/548M/2024.

Arodiogbu pointed out that the APC, as a political party registered in Nigeria, was not involved in the suit and had not received any such injunction.

He said the Independent National Electoral Commission (INEC) had also not joined the suit as required by the 2022 Electoral Act.

The APC warned against any unauthorized persons attempting to gain access to party properties, offices or assets.

Arodiogbu also stressed that the APC constitution strictly prohibits its members from taking legal action against the party without first exhausting internal dispute resolution mechanisms.

Arodiogbu said: “Some of the parties and official positions mentioned in the interim injunction circulated in the media are totally unknown to the party and the amended constitution of the party.

“And that is why the party insists that an opposition party in Enugu State is involved in the media-manufactured crisis in our party.”

He mentioned a similar incident, saying, “A few months ago, it was Kano State where the opposition party unsuccessfully tried to embarrass our party with an injunction against our National Chairman, HE Dr. Umar Ghanduje and now it is Enugu State where the forces are obviously afraid of our celebrated hard-working State Chairman, Honourable Ugochukwu H. Agballah who is courageously rooting out very powerful moles and bringing back discipline and dignity to our Enugu part of the state.

“The party has also filed a petition with the NJC against Justice CVC Ezeugwu for granting an interim injunction against persons and offices unknown to the APC in a matter to which the APC is not a legal party without notifying the party in accordance with the rules of the court and the directions of the NJC.”
