Burgum signs executive order clarifying role and terms of Olmstead Commission

(KNOX) –– Governor Doug Burgum has issued an executive order defining the membership, role and terms of the Olmstead Commissionwhose goal is to advance North Dakota toward greater integration and inclusion of people with disabilities in community services and supports, employment, education, health care, housing and transportation.

Under the previous composition of the Olmstead Commission, all but two of its ten members would have ended their terms at the same time. The new regulation staggers the terms of office, clarifies the role of the commission and expands the categories from which members can be appointed.

In addition, one additional member was added, bringing the total number of members to 11 to avoid a tie vote. Current members of the Olmstead Commission are encouraged to run for reappointment.

The landmark Olmstead vs. LC A June 1999 Supreme Court ruling confirmed that unjustified segregation of people with disabilities constitutes discrimination under Title II of the Americans with Disabilities Act.

In line with this decision, North Dakota established an Olmstead Commission in 2001 and committed to promoting the integration and inclusion of people with disabilities in society, striving to create an environment in which people can live, learn, work and thrive in the least restrictive environment possible.

In April, the Olmstead Commission announced the release of its first comprehensive update to the state plan since 2002.
