The recent CrowdStrike outage resulted in thousands of flight cancellations and delays and cost customers thousands of dollars, according to a new class action lawsuit filed by Delta.

On July 19, an automatic update to CrowdStrike’s cybersecurity software reportedly caused millions of computers running Microsoft Windows to crash. Many airports and airlines, including Delta, were affected by the issue.

Delta’s class action lawsuit alleges that there were more than 4,000 flight cancellations and 35,500 flight delays worldwide as a result of the CrowdStrike outage.

“By the end of the weekend, nearly all airlines had managed to recover and resume normal operations,” Delta’s lawsuit alleges about the flight cancellations. “Delta, however, has not resumed normal operations.”

Plaintiffs Arben Bajra, John Brennan, Asher Einhorn and Melanie Susman say their flights were affected by the Crowdstrike disruption. Delta’s class action lawsuit describes their problems with flight cancellations, delays and how they struggled to find accommodation while waiting for their flights home.

Plaintiffs claim Delta flight cancellations lasted two weeks

Although Delta reported a return to normal “operational reliability” on July 25, Delta’s class action lawsuit alleges that disruptions and flight cancellations continued for nearly two weeks after the initial CrowdStrike outage.

“The impact on Delta passengers was catastrophic,” the lawsuit alleges about Delta’s flight cancellations. “Delta’s failure to recover from the CrowdStrike outage left passengers stranded at airports across the country and around the world, in many cases thousands of miles from home.”

Delta denied affected passengers’ requests for refunds for their canceled or delayed flights and refused to issue affected passengers vouchers for meals, hotels and ground transportation, the plaintiffs claim.

The plaintiffs allege that they had to spend thousands of dollars out of their own pocket on hotel rooms, transportation, flights on various airlines, meals and other expenses.

Delta offered the plaintiffs a $100 voucher for future flights, and in some cases they were even offered a refund that they said was far less than what they were entitled to.

They filed the class action lawsuit against Delta on behalf of themselves and on behalf of a proposed class of consumers in the United States who purchased Delta flights and sought to have their flights canceled or whose flights were canceled between July 19 and July 31, 2024.

The lawsuit over Delta’s flight cancellations alleges breach of contract, common law fraud, unjust enrichment and violations of various state laws.

The US Department of Transportation has a Investigation into Delta flight cancellations related to the CrowdStrike software update.
