Woman sues JetBlue after breaking ankle on flight to the Bahamas

A woman suffered an accident on her flight to her tropical vacation that broke her ankle and ruined her vacation plans.

Maria Mistretta, a passenger from Long Island, is suing JetBlue Airlines for an injury she sustained on her July 23 flight from John F. Kennedy International Airport to the Bahamas and for the airline’s failure to provide assistance.

As Mistretta stood up from her seat, her foot allegedly “became caught in a dangling seat belt or other object, causing her to fall backward. As she fell backward, plaintiff’s foot twisted and cracked, and (Mistretta) landed on her back with her foot still caught in the low-hanging object.”

Maria Mistretta and her husband Salvatore Mistretta claim in their lawsuit that JetBlue failed to provide her with medical care or accommodations to ensure her broken ankle was properly cared for.

“(Mistretta and her husband) asked the crew for a first aid kit and ice, but crew members told them everything was packed and inaccessible for the remainder of the flight,” the court filing said.

It continued: “The flight crew also informed the plaintiffs that they would have to wait until all other passengers had disembarked before they could leave the aircraft.”

The plaintiffs claim that even when they were allowed to disembark, the airline could only provide her with a “broken” wheelchair with no support for her broken leg.

When they arrived in the Bahamas, the Mistrettas claim they were advised not to call an ambulance and were instead forced to book a flight back to New York, go through airport security again and seek medical attention themselves.

During an examination at a New York emergency room, Mistretta was allegedly diagnosed with a fractured right ankle, deep vein thrombosis and the aggravation of a previous back injury, the lawsuit says.
